The deal, in plain English

1. Who we are

GiveCX is a business name (DBA) of Now Services LLC, a Mississippi limited liability company based in Gulfport, Mississippi. “We” and “us” mean GiveCX. “You” means the business that asked for or paid for a website. Reach us any time through our contact page or by replying to any email we send you.

2. The free preview

• We build your preview site for free. You don't owe anything unless you choose to keep it.
• Changes before you decide are free too.
• The preview belongs to us until you pay. If you don't keep it within 30 days, we may take it down. Your content stays yours either way (see section 8).

3. Your two options

• We host it: $39 per month. We keep the site online and make your small updates.
• Buy it outright: $400, one time. The site is yours and we hand over the files.

The price you pay is the one shown at checkout. If we ever change the hosting price, we'll email you at least 30 days before it applies to you.

4. The hosting plan

Your monthly plan includes:

• Hosting, a security certificate (the padlock), and keeping the site running and up to date.
• Small updates, like new hours, prices, menus, specials, photos or wording. Just reply to any of our emails. We aim to make them within 2 business days.
• Bigger jobs, like new pages, a redesign, online booking or a store, are not included. We'll quote those first and only do them if you say yes.

We work hard to keep your site up, but we can't promise it will never be down. Our hosting provider sometimes has outages outside our control.

5. Billing

• Hosting is billed monthly in advance, starting the day you sign up, through our payment processor, Stripe. We never see or store your full card number.
• If a payment fails, Stripe will retry it and email you so you can update your card.
• If a payment is still unpaid after 30 days, we may pause your site until it's paid.
• You're responsible for any taxes that apply to your purchase.

6. Cancelling hosting

• Cancel any time at givecx.com/billing, or just tell us. There's no contract and no cancellation fee.
• Your site stays up through the end of the month you've already paid for. We don't refund partial months.
• After that, we take the site down. You keep your domain and all of your content. If you'd rather keep the site itself, you can buy it outright at the current buyout price before your paid month ends.
• We may also end hosting with 30 days' notice. If we do, we'll refund any unused time you paid for.

7. Buying your site outright

• Once you pay, we send you the site files within 5 business days.
• For 30 days after hand-off, we'll fix anything we built that doesn't work as it should, at no charge.
• You own the finished site and can host it anywhere. Hosting, updates and anything that changes after hand-off are up to you, unless you choose our hosting plan.
• We keep the right to reuse our general templates, code, layouts and know-how for other customers. We won't reuse your content or branding.

8. Your domain is yours

• Your web address (domain) is registered in your name, in your own account, and belongs to you. You pay the yearly renewal directly to the company you bought it from.
• You give us “manager” access so we can point it at your site. You can remove that access any time. We will never hold your domain hostage.
• If we ever register a domain for you, it's still yours. We'll transfer it to you whenever you ask, at no charge.
• Keeping your domain renewed is your responsibility. We'll try to remind you if we notice it's about to expire.
• We may recommend a domain company and earn a small commission if you buy through our link. It costs you nothing extra.

9. Your content is yours

• Your business name, logo, photos, text and information belong to you.
• You give us permission to use them to build, run and update your site.
• You confirm you have the right to use everything you send us, and that what your site says about your business (prices, hours, licenses, claims) is accurate.

10. Our work

• On the hosting plan, we own the design and code of your site and let you use it for as long as your plan is active. Buying the site outright transfers it to you (see section 7).
• We may show your site in our portfolio and marketing. If you'd rather we didn't, tell us and we'll stop.

11. What we won't host

We won't build or host anything illegal, misleading, hateful, or that infringes someone else's rights. If a site breaks this rule, we may take it down. If we do, we'll refund any unused time you paid for.

12. Limits on our responsibility

We provide our websites and services “as is.” To the extent the law allows, we aren't responsible for lost profits, lost business or other indirect losses. Our total responsibility for any claim is limited to what you paid us in the 3 months before the claim, or the buyout price if you bought your site outright.

13. Changes to these terms

We may update these terms. If a change matters, we'll email you before it takes effect. The date at the top shows the latest version.

14. Mississippi law

These terms are governed by the laws of the State of Mississippi. If we ever disagree, we'll try to sort it out by talking first. If we can't, any dispute will be handled in the courts of Harrison County, Mississippi.
